Sometimes I get some amazing questions from our agents. Recently I an agent asked "Is it OK if I just do an Addendum for a Credit and skip the Request for the Repairs?" The simple answer is, yes. You CAN do that, but; why would you leave yourself open to litigation?
The really awesome feature of the Request for Repairs form is the "Release". This is a clause that the buyer agrees to once the form is fully executed:" Buyer releases Seller from any loss, liability, expense, claim or cause of action regarding the disclosed condition of the Property (“Release”)." Make the buyer show that they are accepting the disclosed property condition in lieu of that credit in writing! The only way to do that is to use the Request for Repairs. Let's help protect all parties by getting this release signed for our file.
Now let's take this a step further; what if there is no request for repairs? Let's get a waiver signed that has the buyer agree in writing that they are not requesting any repairs, (Buyer's agents let's show we have informed them of this right!) AND let's include that "Release" on that waiver.
