Everything is "AS-IS"!!

Buyer's Agents: Don't let Listing Agents bully your buyers in to not requesting material repairs, (repairs that would affect the value of the property), with the verbiage "AS-IS" on the counter.



I keep seeing Listing Agents write in their counters that the property is being sold in 'As-Is' Condition.


And I am thinking they are doing this with the intention of discouraging buyers from requesting material repairs to be corrected.





So let's look at our contract!!

CA RPA Paragraph 11 Reads: Unless otherwise agreed in writing: (i) The property is sold in (a) "AS-IS" condition... as of date of Acceptance and (b) subject to Buyer's investigation rights...


So let me spell this out for you. AS-IS condition is always subject to buyer investigation!!


If the Listing Agent's intention is for the buyer to, hands down, buy the property regardless of inspections and not request any repairs, then they should request that buyer remove their inspection contingency upon acceptance of offer.
